President Biden’s administration circumvented federal rulemaking procedure.
The justices of the U.S. Supreme Court heard a case last week regarding the public charge rule that pertains to immigrants and the likelihood that they will be dependent upon government aid and welfare programs. President Biden had removed a rule from the Federal Register that had been placed by the previous administration and replaced it with a new public charge rule.
During proceedings, Chief Justice John Roberts commented on the apparent violation of the government’s Administrative Procedure Act (APA). The chief justice said the court must “think long and hard before adopting a rule that allows any administration to circumvent notice and comment rulemaking before the repeal of a rule.”
